Legal information about contracts, payment, delivery and made-to-measure orders.
1. Scope
These Terms and Conditions apply to all contracts concluded through the online atelier www.marziani.de between Marziani, owner Simao Paulo Da Silva, Watzenweg 10, 21033 Hamburg, Germany, hereinafter referred to as “Marziani”, and our customers.
Marziani stands for craftsmanship, precision and uncompromising quality. These Terms and Conditions define the basis of this collaboration in a clear, transparent and binding form.
2. Definition of Consumer
A consumer within the meaning of these Terms and Conditions is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or independent professional activity.
3. Conclusion of Contract
The presentation of our made-to-measure products in the online atelier does not constitute a legally binding offer, but serves as stylistic orientation and information.
By completing the order process, you submit a binding offer to conclude a purchase contract. The contract is concluded once we confirm your order by email or begin production of your made-to-measure item.
4. Prices and Payment
All prices are final prices including statutory VAT. Made-to-measure items are produced individually according to your specifications and calculated accordingly.
Payment is made using the payment methods offered in the online atelier. Precise handcrafting of your order begins only after payment has been received.
5. Delivery and Transfer of Risk
Delivery is made to the delivery address provided by you. For consumers, the risk of accidental loss or deterioration of the goods passes only upon handover to the customer.
6. Retention of Title
Each made-to-measure item remains the property of Marziani until full payment has been received — as an expression of our commitment to quality, responsibility and craftsmanship.
7. Right of Withdrawal
Consumers have a statutory right of withdrawal of 14 days, unless the product is a made-to-measure item. Details regarding withdrawal can be found in our withdrawal policy.
8. Exclusion of the Right of Withdrawal for Made-to-Measure Items
The right of withdrawal does not apply to goods that are not prefabricated and are clearly tailored to the customer’s personal needs. Every Marziani piece is an individual item.
9. Warranty
Statutory warranty rights apply. Marziani stands for the highest quality standards and carefully inspects every item before delivery.
10. Liability
Marziani is fully liable in cases of intent, gross negligence and injury to life, body or health. In cases of slight negligence, we are liable only for the breach of essential contractual obligations.
11. Data Protection
The protection of your data is part of our quality promise. Our privacy policy applies and is available on our website.
12. Final Provisions
The law of the Federal Republic of Germany applies. The place of jurisdiction is Hamburg where legally permissible.
